This report sets out proposals to acquire 36 Church End, Hendon for the Hendon Hub redevelopmentas partof theland assemblyof theprivately ownedland withinthe redline of the proposed development, at an acquisition price detailed in the exempt report.

The proposedacquisition isa one-bedroomflat heldleasehold with92 years remaining, where LBB are the freeholder.

The currentowner hasnow hadher offeraccepted onher newproperty, hasundertaken surveys on the new property, and instructed solicitors for her sale and new purchase, of which her new purchase is not held in a chain.She would therefore like to progress the sale and her new purchase as soon as possible.

This report sets outproposals toacquire flat 34 Church End, Hendon for the Hendon Hub redevelopmentas partof theland assemblyof theprivately ownedland withinthe redline of the proposed development.

The proposedacquisition isa one-bedroomflat heldleasehold, 125years from01 October 1984, where the London Borough of Barnet Council (LBB) are the freeholder.

To execute a) Deed of Variations to Brent Cross South (BXS) Project Agreement and Corporate Documents (Limited Partnership Deed, Shareholders' Agreement, DMIDA, Collateral Warranty and Delegated Warranty) and ancillary documents b) Homes England Documents (Facility Agreement, Direct Agreement, Deed of Indemnity and Counter Indemnity, Legal Charge and Deed of Subordination).

1)     To authorise the execution of a Deed of Variation to the Brent Cross South (BXS) Project Agreement and Corporate Documents (Limited Partnership Deed, Shareholders'Agreement, CollateralWarranty andDelegation Warranty)and ancillary documents;

2)     To authorise the execution of a Homes England Loan Facility Agreement with BXS and Homes England and the Direct Agreement between Homes England and the Counciland ancillarydocuments includingDeed ofIndemnity andCounter Indemnity, Legal Charge and Deed ofSubordination.

A full list of documents for sealing and/or signing by the Council is attached at Appendix 1.

Pursuant to Decision Item 10 ‘Enabling Digital Infrastructure’, at Housing and Growth Committee on Monday 14th September 2020, the Committee delegated authority to the Director of Growth to enter into overarching commercial agreements for the implementation of broadband infrastructure.

This report follows the previous approval of a Wayleave Framework Agreement that agreed terms for the submission and approval of wayleaves relating to the supply of broadband infrastructure.  In addition, it included approval for the future delegation of decisions regarding wayleave agreements to any Director, Assistant Director or Head of Service with relevant responsibility for housing.

This delegated report confirms the approval to sign a wayleave with Community Fibre Limited for the installation of Gigabit Broadband services in the following areas:

(i)    Grahame Park North

(ii)   Grahame Park South

The Worshipful the Mayor moved reception and adoption of the recommendations in the report.

On the recommendations in the report being put to the vote, the recommendations were unanimously agreed.

RESOLVED that Council:

1.    Approved the recommendation of the London Councils Leaders’ Committee for an overall level of expenditure and borough contributions of £6,668,000 in 2021/22, involving a levy on Barnet of £294,546.

2.    Instructed the Director of Finance to inform the Chief Executive of London Councils accordingly.

To approve an extension to the work already being done by Ernst & Young as a Single Tender Action for the period of 12 months from 11 January 2021 to 24 December 2021.
