THE BARNET COUNCIL SUMMARY DECISION OF THE LICENSING SUB-COMMITTEE (“Sub-Committee”)

 

30th September 2022

 

At Hotix, 1 Burlington Parade, Cricklewood Broadway, London, NW2 6QG (“the Premises”)

 

The Sub-Committee has considered an application for a new premises licence under section 17 of the Licensing Act 2003.

 

The application is for the supply of alcohol (on the Premises) Tuesday to Sunday 14:00 – 23:30. The application is also for the provision of late-night refreshments Tuesday to Sunday 23:00 to 00:00.

 

The Sub-Committee has carefully considered all the relevant information including:

 

           Written and oral representations by all the parties;

           The Licensing Act 2003 and the steps appropriate to promote the licensing objectives;

           The Guidance issued under section 182 of the Licensing Act 2003;

           The Council’s Licensing Policy; and

           The Human Rights Act 1998.

 

The Sub-Committee was held in person.

 

The Sub-Committee heard from the Licensing Officer who presented their report. The Application was submitted on 6th August 2022 by the Applicant. The licensable activity applied for the provision of late-night refreshments Tuesday to Sunday 23:00 to 00:00 and the supply of alcohol on Premises Tuesday to Sunday 14:00 to 23:30. The Premises is currently unlicensed.

 

The Licensing Team received 8 valid objections from local residents, the representations relate to the licensing objectives of the prevention of crime and disorder and the prevention of public nuisance. The Licensing Team did not receive any representations from Responsible Authorities.

 

The Sub-Committee heard from the Applicant. She advised that she is a new business owner and is the Designated Premises Supervisor for the Premises. The Applicant advised that she understood the licensing objections and would do her best to ensure that it is promoted, and her staff would be trained to achieve the licensing objectives. The Applicant further advised that she had installed CCTV in the Premises.

 

The Applicant advised the Sub-Committee that she was aware of the concerns which local residents as there used to be local pub which had issues surrounding noise nuisance, anti-social behaviour and public urination. Prior to the Sub-Committee hearing, the Applicant had spoken to local residents regarding the application to assure them that the Premises would be compliant with the licensing objectives. The Applicant further advised that the residential premises above the Premises did not object to the application and had supported her application for late-night refreshments and supply of alcohol on the Premises. The Applicant informed the Sub-Committee that the area was being regenerated and this Premises would be an addition to the area as there was not any similar businesses in close proximity.

 

The Applicant further advised that she had already obtained a licence to sell food and drink on the pavement outside the Premises. The Applicant offered an additional two conditions that alcohol would only be served with food and that she could close the forecourt earlier to reduce any noise nuisance to local residents. The Applicant further advised that she welcomes any recommendations from the Sub-Committee.
