Notification of decision following a licensing sub-committee hearing to determine an application for a premises licence

TAKE NOTICE:

 

THAT following a hearing before the Licensing Sub Committee

 

ON      30 September 2022

 

THE LONDON BOROUGH OF BARNET, as the Licensing Authority for the premises

 

RESOLVED

 

TO GRANT THE PREMISES LICENCE AS APPLIED FOR.

 

 

REASONS:

 

The Licensing sub-committee carefully considered all the relevant information including:

 

  • Written and oral representations by all the parties
  • The Licensing Act 2003 and the steps that are appropriate to promote the licensing objectives
  • The Guidance issued under section 182 of the Licensing Act 2003
  • The Council’s Licensing Policy
  • Human Rights Act 1998

 

The Licensing sub-committee hearing was held in person.

 

In making its decision, the Licensing sub-committee carefully considered the application and the written representation, as set out within the report and the verbal representations made at the hearing by the applicant’s representative.  The objector did not attend the meeting but his written representation was taken into account.

 

The Licensing sub-committee heard that the site has previously held a premises licence from 2012 with no reported problems or concerns from the responsible authorities. The premises licence was surrendered as the site has recently been demolished and a new premises is being constructed, to be a Shell petrol station and Little Waitrose, and hence the application for a new licence.

 

The Licensing sub-committee also heard that the applicant invited the objector to meet with them to discuss the application and his concerns, but this was declined.  Upon being questioned, the applicant’s representative explained the training that staff are given to sell alcohol and the measures taken to ensure proper management of the same.  

 

The Licensing sub-committee considered that the measures to be taken by the premises are appropriate and proportionate to promote the licensing objectives, and therefore allows the application for the premises licence.  To be clear, it is confirmed that customers purchasing late night refreshment can take these away from the premises to consume.

 

 

Right to appeal

Any party aggrieved with the decision of the licensing sub-committee on one or more of the grounds set out in schedule 5 of the Licensing Act 2003 may appeal to the magistrates’ court within 21 days of notification of this decision.
