RESOLVED TO APPROVE the application as per the Officer’s report with the following additional condition. 

 

 

Additional Condition:

Before the development hereby permitted is first occupied the proposed doors in the front elevation shall be installed in accordance with details that have previously been submitted to and agreed in writing by the Local Planning Authority and shall be permanently retained in accordance with the approved details thereafter.

 

Reason: Reason: To safeguard the visual amenities of the building and surrounding area in accordance with Policy DM01 of the Development Management Policies DPD (adopted September 2012) and Policies CS NPPF and CS1 of the Local Plan Core Strategy (adopted September 2012).

The Committee having heard from substitute speaker Mr Rider who spoke in objection to the application and a representation from the applicant’s representative. 

 

RESOLVED TO APPROVE the application subject to the following

amendments:

 

Amend condition 7

 

 

Before the development hereby permitted is first occupied, the proposed high level windows in the flank elevation facing no.270 Friern Barnet Lane shall be installed as shown on plan no 190-PL(20) E00 Rev P2 with the bottom cill being a minimum of 2000mm above finished floor level and these windows shall all be glazed with obscure glass only and shall be retained as such thereafter and shall be permanently fixed shut with only a fanlight opening.

 

Reason: To safeguard the privacy and amenities of occupiers of adjoining residential properties in accordance with Policy DM01 of the Development Management Policies DPD (adopted September 2012) and the Residential Design Guidance SPD (adopted April 2013).

 

Amend Condition 8 to:

Notwithstanding the details included in the application, no development or site works shall take place until details of the proposed first floor terraces, roof garden and privacy screens have been submitted to and approved in writing by the Local Planning Authority. The details shall include levels, surface treatment, hard and soft landscaping, means of enclosure together with details of the proposed privacy screens along the flank wall abutting the boundary with no. 270 Friern Barnet Lane and along the southern side of the proposed roof garden. The privacy screens and terrace shall be installed in accordance with the details as approved and shall be permanently retained as such thereafter.

 

Reason: To ensure that the development does not prejudice the amenity of future occupiers or the character of the area in accordance with policies DM01 and DM02 of the Development Management Policies DPD (adopted September 2012), the Residential Design Guidance SPD (adopted April 2013) and the Sustainable Design and Construction SPD (adopted April 2013).

 

Additional condition:

 

 

Notwithstanding the details included in the application, the development hereby permitted shall not be occupied until details of the proposed roof lights facing no. 270 Friern Barnet Lane have been submitted to and approved in writing by the Local Planning Authority. The details shall include details of obscure glazing together with any other measures necessary to protect the privacy of neighbouring residents at that property. The widows shall be installed in accordance with the approved details before proposed flat 5 is first occupied and shall be permanently retained in accordance with the details as approved thereafter.

 

 

Reason: To safeguard the privacy and amenities of occupiers of adjoining residential properties in accordance with Policy DM01 of the Development Management Policies DPD (adopted September 2012).

 

Additional condition

a)    Before the development hereby permitted is first occupied, details of privacy screens to be installed to the proposed second floor terrace to unit 5 shall be submitted to and approved in writing by the Local Planning Authority.

RESOLVED TO APPROVE the application including the following amendments:

 

Amend and renumber condition 5. Condition 5 has been reordered to be condition 17 and has been amended to read as: 

 

No site works (including any temporary enabling works, site clearance and demolition) or development shall take place until the temporary tree protection as detailed in the approved Arboricultural Report dated November 2014 has been erected around existing trees on site. This protection shall remain in position until after the development works are completed and no material or soil shall be stored within these fenced areas at any time.

 

Reason: To safeguard the health of existing tree(s) which represent an important amenity feature in accordance with Policy DM01 of the Development Management Policies DPD (adopted September 2012), Policies CS5 and CS7 of the Local Plan Core Strategy (adopted September 2012) and Policy 7.21 of the London Plan 2011.

 

Additional Conditional:

The property shall be used as self-contained units as shown in the hereby approved drawings under Class C3(a) and no other purpose (including any other purpose in Class C3 or C4 of the Schedule to the Town and Country Planning (Use Classes) Order 1987, or in any provision equivalent to that Class in any statutory instrument revoking and re-enacting that Order, with or without modification).

 

 

Reason: To enable the Local Planning Authority to exercise control of the type of use within the category in order to safeguard the amenities of the area.
