Notification of decision following a Licensing Sub-Committee hearing held on 16 June 2022 to determine an application for a premises licence

RESOLVED

 

TO GRANT THE PREMISES LICENCE (with the inclusion of the 45 conditions agreed with the Police with slight amendments noted below):

REASONS:

The Licensing Sub-Committee carefully considered all the relevant information including:

 

·         Written and oral representations by all the parties

·         The Licensing Act 2003 and the steps that are appropriate to promote the licensing objectives

·         The Guidance issued under section 182 of the Licensing Act 2003

·         The Council’s Licensing Policy

·         Human Rights Act 1998

 

The Licensing Sub-Committee hearing was held in person.

 

In making its decision, the Licensing Sub-Committee carefully considered the application and all written representations, as set out within the report, and the verbal representations made at the hearing by the applicant’s representative. The Mill Hill Preservation Society, who had made a representation, were not in attendance but the Licensing Sub-Committee considered their written submissions in close detail, especially their concerns about public nuisance relating to noise and urination. The Licensing Sub-Committee noted that whilst the applicant had helped to address some of the concerns raised in the original representation through correspondence, there were still some other aspects of concern for the Society, and the Licensing Sub-Committee themselves.

 

The Licensing Sub-Committee asked several questions of the applicant covering issues including capacity limits, noise level management, car parking/traffic management, security measures, and sale of alcohol, to ensure that the licensing objectives are not undermined.

 

The Licensing Sub-Committee heard about how the event will not have more than 9,999 persons at any one time (including staff and event participants) and how the noise levels are to be managed and monitored and the fact that there will be a hotline for people to call too. The Licensing Sub-Committee also heard about the plans that have been made (and to be developed further) with the Council’s Safety Advisory Group in relation to security, covering drug concerns as well as bomb and anti-terrorism measures, and the fact that there will be 170 SIA security staff at the event.

 

In addition, the Licensing Sub-Committee noted the extensive conditions agreed with the Police and the fact that no responsible authorities had made any representations.

 

The Licensing Sub-Committee amends two of the police agreed conditions as follows:

 

Condition 1 – remove the word ‘strong’ from the condition.

Condition 3 – add wording to the second sentence so that this condition now reads:

 

3. Whenever the premises are open to the public a Personal Licence Holder shall be present within the licenced premises.

 

Each bar will be run by a bar supervisor, this person will be under the direction of the Designated Premises Supervisor who will be on site throughout the licensed hours. At least one SIA trained security staff will be stationed continuously in the bar areas whilst open to the public.

 

The Licensing Sub-Committee believes that based on the submissions made by the applicant together with the conditions agreed with the Police (as amended), the measures taken are appropriate and proportionate to promote all the licensing objectives, and therefore allows the application for the premises licence.

 

Right to appeal

Any party aggrieved with the decision of the Licensing Sub-Committee on one or more of the grounds set out in schedule 5 of the Licensing Act 2003 may appeal to the Magistrates’ Court within 21 days of notification of this decision.
