The Chairman decided to change the order of items by discussing the Community Right to Bid nomination for the Builder’s Arms first and then the Community Right to Bid nomination for Lord Nelson.

 

The Chairman introduced the report which related to an Asset of Community Value application (Community Right to Bid nomination) for the Builders Arms submitted by the local Enfield and Barnet branch of the national organisation, CAMRA (The Campaign for Real Ale) and dated the 2nd May 2016. The legal officer outlined the legal position regarding the nomination and advised on the provisions of the Localism Act 2011 and 2012 Regulations which sets out the statutory tests that must be applied and satisfied   to determine whether a nomination has been made by an eligible body.

 

The committee requested for a report to be submitted to the next Community Leadership Committee meeting to update the committee on the procedure for nominations.

 

Following discussion of the item and in-line with the advice from the legal officer, the Chairman moved a motion which was seconded and agreed to substitute the recommendation outlined in the report with the following:

 

That upon reviewing the representations received on behalf of the Owner for the Builders Arms on the 22nd of June subsequent to publication of the main report as attached to the Addendum Report and the committee having had regard to the statutory criteria set out in the Localism Act 2011 together with the Assets of Community Value (England) Regulations 2012, that the Committee decide not to include the Builder’s Arms on the council’s register of listed assets.

 

The Committee agreed the recommendation, therefore the motion was declared CARRIED.

 

The Chairman moved to the revised recommendation and the Committee RESOLVED-

 

That upon reviewing the representations received on behalf of the Owner for the Builders Armson the 22nd of June subsequent to publication of the main report as attached to the Addendum Report and the committee having had regard to the statutory criteria set out in the Localism Act 2011 together with the Assets of Community Value (England) Regulations 2012, that the Committee decide not to include the Builder’s Arms on the council’s register of listed assets.

The Chairman introduced the report which related to an Asset of Community Value application (Community Right to Bid nomination) for Lord Nelson  on behalf of the local Barnet and Enfield CAMRA branch also dated the 2nd May 2016.

 

The committee agreed that following Freeths’ representations in respect of the nomination for the Builder’s Arms, the same concerns as regards the applicant’s eligibility would need to be taken into account in respect of to the Community Right to Bid nomination for the Lord Nelson.

 

The Chairman moved a motion which was seconded and agreed to substitute the recommendation in the report with the following:

 

That upon reviewing the representations received on behalf of the Owner for the Builders Arms on the 22nd of June subsequent to publication of the main report as attached to the Addendum Report and the committee having had regard to the statutory criteria set out in the Localism Act 2011 together with the Assets of Community Value (England) Regulations 2012, that the Committee decide not to include the Lord Nelson on the council’s register of listed assets.
