The Chairman introduced the sub-Committee Members and explained the procedure that would be followed at the meeting.

Minutes:

The Sub-Committee considered an application for a Temporary Event Notice under the Section 100 of Licensing Act 2003. The Sub-Committee heard oral representations from the Licensing Officer, the Police and the applicant.

Re-admission of the Press and Public: Announcement of the decision of the Sub-Committee

The Sub-Committee, having considered the application and all verbal and written representations received, unanimously RESOLVED

 

This is an application for a Temporary Events Notice by Cavendish Banqueting FCI House, Edgware Road Colindale for what is described as a New Year’s Eve event from one minute past midnight until 06.00 on 1st January 2015.

 

The Police have objected to this application stating that it would undermine the licensing objectives of the prevention of crime and disorder and the prevention of nuisance. The Police require a risk assessment form when such events are planned and state that the applicant rarely provides one. In this instance such a form has been provided but the scale of the event is such that the Police would require considerable planning that would take longer than the time available until New Year’s Eve.

 

The Sub-Committee understand from the Police that there was an ugly disturbance outside the premises on 28 November 2014 which required the presence of Officers from three different Boroughs to sort out fights and alcohol fuelled anti-social behaviour. The police say that this shows a lack of control and responsibility exercised by the applicant.

 

The police also say that the promoter is unknown to them, and that the premises shown by him as an example of his experience is much smaller and not at all similar to these premises.

 

The noise nuisance officer also stated that her department had received noise complaints on that day. The Panel noted that Environmental Health had served a noise abatement notice on the premises following last year’s New Years eve event.

 

In response to this the applicant states that they will have 15 security staff and 4 stewards making sure that customers leave quietly and with proper regard for the neighbours. This was not in force last year. They have hired a car park with a maximum capacity of 50 cars in order to prevent as far as possible noise from customers parking in side streets and making a noise when leaving.

 

The applicant has also asked to amend its application so that the sale of alcohol terminates at 04.00 and the premises close at 04.30. The Panel does have concerns over even this hour but on the basis of the proposals referred to above relating to security we hope that the application as amended will not undermine the licensing objectives. The applicant will be aware of the likely consequences should there be any difficulty.

 

The Sub-Committees grants the amended application.
