Having heard from local residents Mr Jonathan Schawrz, Mr Anthony Davis and Mr Mark Gibney the Planning Consultant;
The Committee;
RESOLVED TO APPROVE the application as per the officer’s report and subject to (i) completion of the Section 106 Agreement (ii) the updates contained within the addendum (iii) the conditions set out in the report and the following change made at the meeting;
Amendment to Condition 5 ;
Notwithstanding the details submitted with the application and otherwise hereby approved, before the development hereby permitted is brought into use or occupied details of the: · enclosures, screened facilities and/or internal areas of the proposed buildings to be used for the storage of recycling containers, wheeled refuse bins and any other refuse storage containers where applicable to be located away from the boundary of the site with Reynolds Close;
· satisfactory points of collection to be located away from the boundary of the site with Reynolds Close; and
· details of the refuse and recycling collection arrangements shall be submitted to and approved in writing by the Local Planning Authority. The development shall be implemented and the refuse and recycling facilities provided in full accordance with the details approved under this condition before the development is occupied and the development shall be managed in accordance with the approved details once occupation of the site has commenced”.

The Committee resolved -
1. That the application for registration as a Town or Village Green under Section 15(2) of the Commons Act 2006 be rejected in respect of the land known as ‘land to the West of Friern Barnet Library’ on the basis that the qualifying criteria laid down in the Act for a new Town or Village Green are not satisfied.
2. That the applicant and landowner be informed of this decision in writing.

RESOLVED - That the application for registration as a Town or Village Green under Section 15(2) of the Commons Act 2006 in respect of the land known as The Reddings Green, between Reddings Close and Lawrence Street, Mill Hill, NW7, as shown on the site location plan 2 is REFUSED as the application cannot meet the requirements of s15(2) of the Act as the applicant’s use has been ‘by right’ and not ‘as of right’ and it cannot be established that the use of the land by the applicants has been without permission of the landowner which in this case is LB Barnet. |
