RESOLVED - That the minutes of the meeting held on 12 November 2013 be approved as a correct record.

Apologies for absence were received from Councillor Wendy Prentice who was substituted by Councillor Graham Old and Councillor Mark Shooter.

None were declared.

There were none.

A briefing on betting shops was circulated to the Committee.

Having considered the briefing, the Committee agreed to defer this item to its next meeting to enable a Planning Policy Officer to attend.  This would allow for more a more in-depth and thorough discussion on contents of the report.

The Vice-Chairman also advised the Committee a deferral would be appropriate in view of the fact that the Cabinet Member for Planning, Councillor Joanna Tambourides has written to the Secretary of State for Communities and Local Government, Mr Erick Pickles on the issue of betting shops in Barnet’s High Streets. Councillor Tambourides is currently awaiting a response.

RESOLVED -

1.         That the Member’s Item from Councillor Jim Tierney be deferred to the next meeting of the Committee.

Having heard from Mr Lawson, Mr Pravin Patel, the Planning Consultant and Councillor Brian Coleman, Ward Councillor for Totteridge, the Committee;

RESOLVED TO REFUSE the application in accordance with and for the reasons set out in the officer’s report, subject to the application being referred to the Mayor of London and no direction being received from the Mayor to call in the application or to refuse it for alternative reasons.

As a consequence of a number of residents being unable to attend the meeting, Councillor John Marshall, Ward Councillor for Garden Suburb moved that the item be deferred to award them the opportunity to do so. Councillor Jack Cohen seconded the deferral.

RESOLVED TO APPROVE the application as per the officer’s report and subject to (i) referral to the Mayor of London (ii) completion of the Section 106 Agreement (iii) the updates contained within the addendum, (iv) the conditions set you in the report and the following addition made at the meeting

(v)        conditions 18 and 19 were deleted and moved to the Legal Agreement      and condition 13 was amended to include the words ‘Cycle Parking’

RESOLVED - That the application for registration as a Town or Village Green under Section 15(2) of the Commons Act 2006 in respect of the land known as Finchley Garden Village, Upper and Lower Greens, Village Road, N3 1TL, as shown on the site location plan 2 be REFUSED as the application cannot meet the requirements of s15(2) of the Act as the applicant’s use has been ‘by right’ and not ‘as of right’ and it cannot be established that the use of the land by the applicants has been without permission of the landowner which in this case is LB Barnet.

The Committee noted the receipt of the additional information set out in the tabled addendum.
