The Committee noted the receipt of the additional information set out in the tabled addendum.

 

The Committee having heard oral representations from Mr Kamali who raised his concerns about the lack of parking and the response form the applicant’s representative Mr Steven Gough, the Committee;

 

RESOLVED TO APPROVE the application as per the Officer’s report and subject to (i) the conditions set out in the report, (ii) the updates contained within the Addendum and the following request made by the Committee;

 

iii)         Inclusion of an affordable housing review mechanism within the section 106 legal agreement in the event that the developer/housing association secures housing grant at a future date.

The Committee;

 

RESOLVED TO APPROVE the application as per the Officer’s report and subject to (i) the conditions set out in the report , (ii) the updates contained within the Addendum and the following amendment to condition ;

 

9.         The use hereby permitted shall be for a limited period only and shall cease by 17/06/2018 unless required sooner for highways works associated with the West Hendon Regeneration Scheme in which case the use shall cease when the land is required.

 

Reason:

To ensure that the proposals do not prejudice road widening works associated with the West Hendon Regeneration Scheme, in accordance with policies CS1 and CS2.

Amendment to Planning Delegated Powers

 

The decision was considered to by urgent in order to enable officers to make decisions on applications for prior approval and to ensure that those decisions were made in a timely manner and before the expiry dates to avoid proposed development becoming lawful by default.

 

The Assistant Director Planning & Development Management & Building Control introdcuced the report.

 

Section 1.1.5 of the Scheme of Delegation allows authorised officers to determine applications for prior approval in respect of permitted development proposals but restricted to agricultural, forestry and telecommunications permitted development, in accordance with the Town and Country Planning (General Permitted Development) Order 1995, as amended. The proposal is to amend this section in order to give officers delegated powers to deal with applications for prior approval introduced by the Town and Country Planning (General Permitted Development) (Amendment) Order 2013, which came into force 30th May 2013.

 

The Committee Resolved;

 

1.         That section 1.1.5 of the Scheme of Delegation be amended to read: “Any application for prior approval in relation to permitted development proposals in accordance with the Town and Country Planning (General Permitted Development) Order 1995, as amended.”
