RESOLVED TO APPROVE the application as per the Officer’s report and subject to the conditions as set out in the report, the addendum including the following additional conditional:

 

The proposed use shall be implemented in accordance with the approved floor layout as shown on drawing HNDWY-P101and permanently retained thereafter. Reason: To ensure the that proposals do not harm the vitality and viability of the Hendon Central town centre in accordance with policy DM11 of the Adopted Barnet Development Management Policies 2012.

The Sub-Committee having heard from Dr Joan Mushin who spoke in objection to the application:

 

RESOLVED TO APPROVE the application as per the Officer’s report and subject to the conditions as set out in the report with the following additional condition.

 

Before the development hereby permitted is occupied, details of sound insulation to the party wall with no 935 Finchley Road shall be submitted to and approved in writing by the local planning authority. The development shall be implemented in accordance with these details prior to first occupation.

 

Reason: To safeguard the residential amenities of neighbouring occupiers in accordance with policy DM04 of the Adopted Barnet Development Policies 2012.

 

The roof of the extensions hereby permitted shall only be used in connection with the repair and maintenance of the building and shall at no time be converted to or used as a balcony, roof garden or similar amenity or sitting out area.

 

Reason:

To ensure that the amenities of the occupiers of adjoining properties are not prejudiced by overlooking in accordance with policy DM01 of the Adopted Barnet Development Management Policies DPD (2012).

The Sub-Committee having heard from Mr Shapir and Ms Barnard who spoke in objection and a response from the applicant’s agent:

 

REFUSED the application which was a reversal of Officer’s recommendation as outlined in the report for the following reason:

 

The proposed siting of the disabled parking spaces would result in an unsatisfactory layout that would be detrimental to the residential amenities of residents of the development. The proposals would be contrary to policies DM02 and DM03 of the Adopted Barnet Development Management Policies 2012.
